Terms of Use for House of Control's AI Assistant

This AI Addendum (the "Addendum") is an integral part of the Main Agreement, Terms of Use, or equivalent agreement (the "Agreement") between House of Control AS (the "Supplier") and the customer (the "Customer") regarding the use of AI services. In the event of any conflict between this Addendum and the Agreement, this Addendum shall prevail with respect to the AI services. The Addendum shall enter into force at the moment one of the Customer's end users starts using the AI Assistant.

1. DEFINITIONS

1.1. "AI Assistant" means the AI solution that the Supplier has made available to the Customer to generate Output based on the Supplier's own documentation and closed knowledge base. The AI Assistant does not retrieve information from the open internet and does not have access to real-time data, news, or external sources outside the defined knowledge base.

1.2. "Input" means all prompts, text, data, or other material submitted by the Customer or its end users to the AI Services for processing.

1.3. "Output" means the specific text or information generated and returned to the Customer from the AI Services as a result of the Input. Output does not include the underlying documentation, algorithms, models, software, or the Supplier's existing intellectual property rights.

2. INTELLECTUAL PROPERTY RIGHTS AND DATA RIGHTS

2.1. Rights to Output. The Customer is granted the right to use the Output for its own legitimate purposes. The Customer acknowledges that the AI Services use probability models and may generate identical or substantially similar Output for other users. The Customer shall not claim ownership or assert any infringement claims against the Supplier or other users in relation to identical Output.

2.2. License to the Supplier and Improvement. The Customer grants the Supplier a global, non-exclusive, and royalty-free license to access, use, and process Input and Output in order to: (i) deliver the AI Services; (ii) prevent misuse or security threats; and (iii) use questions and sources to improve and further develop our own knowledge base that the AI assistant has available when responding to inquiries.

2.3. Use of data for training. The Customer accepts that the Supplier and its sub-processor (Unless) may use the Input and Output to fine-tune and improve the performance of the AI assistant.

3. ACCURACY AND CUSTOMER RESPONSIBILITY

3.1. Risk of errors. The AI service generates responses based on the Supplier's internal documentation. Since the technology is based on probability models, the Output may be inaccurate, incomplete, outdated, or contain errors (so-called "hallucinations"). This is particularly true in the case of recent regulatory changes that are not yet reflected in the knowledge base. Information from the AI service does not constitute legal, financial, tax, or other professional advice under any circumstances.

3.2. Verification. The Customer is responsible for critically evaluating and verifying the Output before making decisions or taking action based on the information. If advice is needed in relation to financial or legal matters, the Customer should consult qualified professionals. The Customer must maintain human control ("human in the loop").

3.3. Recommended use. In order to obtain the best possible value and accuracy from the tool, the Customer is encouraged to formulate clear and specific questions, as well as to use follow-up questions to clarify or elaborate on the information.

4. RESTRICTIONS AND ACCEPTABLE USE

4.1. Prohibited use and sanctions. The Customer is obliged to comply with (and ensure that end users comply with) the Guidelines for the use of House of Control's AI services applicable at any given time. Use in violation of these guidelines is considered a material breach of this Addendum and may result in immediate restriction or termination of access to the AI service.

4.2. Third-party terms. The customer acknowledges that the service may depend on third-party models. The Customer is obligated to comply with the security and usage policies of such providers as they may be updated from time to time.

5. PRIVACY AND SECURITY

5.1. Restriction on Input. The Customer shall not input personal data, sensitive information, or confidential information into the AI assistant.

5.2. Sub-processors and Instructions. The Customer hereby authorizes the Provider to use Unless as a new sub-processor. The Customer instructs the Provider to process data uploaded to the AI service, including the disclosure of such data to Unless and Unless's sub-processors. The Customer acknowledges that this instruction may involve the transfer of personal data to countries outside the EEA (including the United States) in accordance with approved transfer mechanisms such as the EU Standard Contractual Clauses (SCC).

6. RESTRICTIONS AND DEVELOPMENT

6.1. Service Development. The Provider may update, remove, or replace models or features at any time. The Provider also reserves the right to change the subcontractor of the AI Assistant.

6.2. Usage restrictions. The Provider reserves the right to impose usage restrictions (e.g., speed limits or quotas) to ensure service stability.

7. LIABILITY AND INDEMNIFICATION

7.1. Limitation of Liability. Responses and content from the AI Assistant are used at your own risk. The Provider is not responsible for any errors made as a result of incorrect responses from the Assistant. The AI assistant is provided “as is” and “as available,” without warranties of any kind, either express or implied, including, but not limited to, warranties of accuracy, completeness, fitness for a particular purpose, or that the information is free from errors. The Supplier's total liability for claims related to the AI services shall in any case be limited to the consideration paid for the AI service during the last twelve (12) months prior to the claim arising.

7.2. Indemnification. The Customer shall indemnify the Supplier for any claim arising as a result of the Customer's Input or breach of Section 4 (Restrictions).

8. CHANGES

The Supplier may amend this Addendum. Non-material changes shall take effect immediately. Material changes shall take effect 30 days after publication. If the user does not accept the changes, use of the AI assistant must be terminated. Continued use after the effective date shall be deemed acceptance of the updated terms.
